You can only catch it after the Elite 4. If your playing the Emerald Version, You can catch Groudon and Kyogre as well.

Emerald: Rayquaza before E4 is possible; Groudon/Kyogre after E4

Rayquaza helped alot in the E4. And you can go back after E4 victory if you avoid the chance shortly after the crisis at SOOTOPOLIS.

NOTE: In Emerald, after the event at SOOTOPOLIS, Rayquaza flies back to the SKY PILLAR. Climb again to engage the encounter. Be warned as the wild Pokies there are at tricky Levels.

For Ruby and Sapphire? Yeah, you catch Rayquaza after you battle the Elite Four.

For Emerald? You can catch Rayquaza before the Elite Four. If you're looking for an easier win against the Elite Four, I'd suggest you catch it before you go. It will take out Sidney, Phoebe and Drake with little problems.
