i was playing firered and save the game then turn it off my nintendo sp put pearl in then played it for some time then turn off my sp again then put firered back in it said your save file has been deleted did some googleing to sadly find i was solded a Illegall copy of pokemon firered on ebay i got it 2 week ago were can i report it

You can probably contact someone on eBay, tell them the person that sold you it, and he'll get penalized.

I do not know were to get it brand New still if i did i would have not have use ebay at all
+ there no way of telling if it is going to work right unless get it first there so from now im not use ebay for that kind stuff

Well, that problem is common nowadays, and the truth is, original versions of Pokemons doesn't even delete saved games that easily.
Not to sound harsh but I think the GBA game you bought was fake.

that what i was thinking because when i got my first game pokemon red not firered
i it work great till it broke by playing it 4 years non-stop how it was broken it keep shuting its self off every few secs so therefore that was the real way a true game should last not like firered lasted two weeks which had to be a real fake game of firered

Did you turned off your gba when it said. Saving don't turn off the power? If you didn't then something must be wrong. Maybe you should get a new one.

Do u know who sold it? cause if so, make a mental and/or physical note to never buy stuff from that person on ebay again.
